These Rules and Regulations for Nikoa Beach Club have been crafted as a comprehensive guide to facilitate the optimal utilization of the amenities outlined in the Membership Plan. While this document may not address every conceivable circumstance, its purpose is to establish a framework that safeguards the facilities, ensuring the well-being, safety, and enjoyment of our valued members, their families, guests, and all others who partake in the club’s offerings.

At Nikoa Beach Club, our commitment is to curate an exceptional and enjoyable club experience for each member and guest. Upholding these standards necessitates that all individuals conduct themselves in a manner consistent with refined taste. The Club reserves the right to make amendments to these Rules and Regulations at its discretion, ensuring they remain pertinent and aligned with the evolving needs and aspirations of our esteemed members.

Membership & Payment

1. Payment and Initiation Fee

Payment will not be required upon notification of acceptance to Nikoa Beach Club until the year 2024.

There will be a one-time nonrefundable initiation fee for applicants.

Additionally, a sales tax of 13% will be added to the membership fee.

Yearly membership fees will not be applicable during the pre-opening phase of Nikoa Beach Club in 2024. After the official opening, a revised fee structure will be communicated.

2. Membership Payment Options

All members are required to choose their preferred payment option for the annual membership at the time of acceptance.

Mandatory Credit/Debit Card Billing: All Nikoa Beach Club Members shall provide the club with one credit or debit card for billing purposes. Members authorize Nikoa Beach Club to charge membership fees to the designated card. Members are responsible for updating their card information when necessary. Past-due membership fees may incur a late fee. Nikoa Beach Club reserves the right to suspend Membership and privileges for fees 15 days past due. The suspension will be enforced until the balance is settled.

3. Credit/Debit Card Billing

Members are required to provide Nikoa Beach Club with a credit or debit card for billing purposes.

Members authorize Nikoa Beach Club to charge membership fees to the designated card.

Members are responsible for updating their card information when the original card expires or is no longer valid.

Past-due membership fees are subject to a late fee.

Nikoa Beach Club reserves the right to suspend Membership and all privileges for fees 15 days past due. The suspension will be enforced until the balance is settled.

4. Membership Website

Each member will be registered on the Nikoa Beach Club website using the Ultimate Members plugin in WordPress.

Members will receive a unique URL through which they can demonstrate their membership at the entrance.

Members are required to show their registered URL when using any of the facilities or making purchases to avail themselves of discounts.

The membership URL is non-transferable and is for individual use only.

Facility Usage

5. Pool Usage

Pool access is granted to members upon showing their membership URL on the Nikoa Beach Club website.

Pool chairs are available on a first-come, first-served basis for members, hotel guests, and residents.

Members are required to show their registered URL upon entry to the pool area.

To ensure fair usage and availability, please refrain from reserving or occupying pool chairs without immediate use.

Continuous violation of the policy regarding pool chair usage may result in membership termination.

6. Gym Access

Gym access is available for all members.

During the pre-opening phase, a nominal fee of 100$ will be charged for gym usage.

The gym operates from 7 am to 9 pm, seven days a week.

The minimum age for gym usage is 16 years; individuals below this age are not permitted.

Appropriate attire, including closed-toe exercise footwear, is mandatory for safety.

Access to the gym is subject to availability, and hotel staff may restrict entry based on capacity.

7. Outside Practitioners

The use of non-Nikoa Beach Club practitioners on the property is strictly prohibited.

All services provided on the property must be offered by Nikoa Beach Club team members and scheduled through the membership website, phone, or in the Beach Club lobby.

Guest & Dining Policies

8. Guest Policy

Members at Nikoa Beach Club are entitled to bring up to 1 complimentary guest on weekends and holidays, and up to 3 complimentary guests on weekdays.

Members must present their open membership app at the pool for access, and guests must be accompanied by the member to gain entry.

The sponsoring member will be held responsible for their guests’ behavior, appearance, and any charges incurred during their visit.

Charges for any services not covered by the guest will be billed to the sponsoring member’s club account.

Nikoa Beach Club strives to accommodate guests without inconvenience to its members but reserves the right to restrict or exclude guests based on certain days or times.

Guest privileges may be denied, withdrawn, or revoked at any time for reasons considered sufficient by the club in its sole discretion.

Nikoa Beach Club does not currently charge members a guest access fee but reserves the right to do so in the future.

9. Pool Guest Policy

Depending on the day of the week and holidays, members may bring up to 1 to 3 guests complimentary to the pool, with blackout dates.

10. Dining Policy

Members may bring guests to dine at the restaurant on a first-come, first-serve basis.

If a member brings 4 or more guests to dine at the restaurant (2 or more guests on weekends and holidays), those guests will not have access to use the pool.

Children’s Policy & Accommodations

11. Children’s Policy

Nikoa Beach Club is designed as an adult program; members are required to accompany children.

Individuals under the age of 21 are not allowed in bar or bar areas.

12. Room Reservations

Exclusive preferred room rates for Nikoa Beach Club members.

Members must provide the Nikoa Beach Club website registration details at check-in to avail of preferred rates.

A valid credit card is required for room reservations, and all charges must be settled at the time of departure.

13. Animals

Only service animals with proper certification are permitted at Nikoa Beach Club.

Members are responsible for providing the service certificate to the Membership Team for record-keeping.

Member Conduct & Responsibilities

14. Lost and Found

Nikoa Beach Club is not liable for the loss or damage to members’ property on the premises.

Members assume sole responsibility for their personal belongings.

15. Member Treatment of Employees

Respectful and non-abusive treatment of Nikoa Beach Club employees is mandatory.

Violation of this rule may result in membership revocation or other disciplinary actions determined by Nikoa Beach Club.

16. Profanity

Members must refrain from using profanity directed at Nikoa Beach Club staff.

17. Mobile Phones

Members are advised to exercise good judgment when using mobile devices to maintain a relaxed atmosphere.

18. Smoking

Smoking is prohibited in all areas.

19. Dress Code

Appropriate attire and shoes are required; members should be cautious around pools and wet areas.

Closed-toe exercise footwear is mandatory in the fitness facility at all times.

20. Pricing

Membership rates are subject to annual review and revision at Nikoa Beach Club.

Membership renewals are not automatic and will be reviewed on an annual basis.

21. Service Charge

Cash tipping is permitted at Nikoa Beach Club.

A service charge may be added to spa treatments and food and beverage sales, as determined by Nikoa Beach Club.

Members can adjust the service charge percentage at their discretion.

22. Waiver of Liability

Members assume full responsibility for facility use and release Nikoa Beach Club from any claims.

Members acknowledge the risk of physical activity and must seek advice from a physician if necessary.

23. Damage Caused by Member

Each member is liable for any property damage caused at Nikoa Beach Club.

Operational Details

24. Hours of Operation

Membership grants access to facilities during operational hours; pool and beach hours are subject to change.

25. Rules, Regulations, and Schedules

Members agree to abide by all Nikoa Beach Club rules, regulations, and schedules posted on-site or issued by management.

26. Additional Expectations

Members are expected to comply with all Nikoa Beach Club policies in addition to the terms in this agreement.

27. Memberships are Non-Transferable

28. Revocation of Membership

Nikoa Beach Club reserves the right to revoke and cancel membership at any time for any reason without explicit explanation.

Membership may be revoked for violations of rules, regulations, or policies.

Cancellation & Consumer Rights

29. Consumer’s Right to Cancellation

Members have the right to cancel the contract within three business days of its making.

Cancellation must be in writing and delivered by certified or registered mail or email.

Refunds will be issued within 30 days.

30. Consumer Protection Clauses

Conditions for cancellation include various scenarios such as business closure, member death, or physical disability.

Members should contact Nikoa Beach Club for information within 60 days in case of business closure.

Azura Resorts Access

31. Access to Azura Resorts Restaurants

Nikoa Beach Club members are granted access to the following restaurants within Azura Resorts: Bocatto (Italian restaurant), Tao (Asian Restaurant), Chill n’ Grill (Steakhouse by the beach), and Choras (Local Costa Rican Food with an international twist).

Access is limited to restaurant facilities only, and additional services within Azura Resorts may not be available to Nikoa Beach Club members unless explicitly stated.

32. Reservation Protocol

Members are required to make reservations for dining at Azura Resorts’ restaurants through the Nikoa Beach Club website or designated reservation system.

Availability is subject to the hotel’s reservation policies, and members should adhere to specified reservation times.

33. Identification Requirement

Nikoa Beach Club members must present their membership app or provide other forms of identification as required by Azura Resorts’ staff before accessing the restaurants.

Members are responsible for ensuring that their guests comply with Azura Resorts’ identification requirements.

34. Code of Conduct at Azura Resorts

Members and their guests must adhere to Azura Resorts’ code of conduct and policies while on the premises.

Any violations may result in the suspension of dining privileges at Azura Resorts for Nikoa Beach Club members.

35. Charges and Settlement

Members are responsible for any charges incurred at Azura Resorts’ restaurants during their visit.

All charges must be settled directly with Azura Resorts as Nikoa Beach Club is not responsible for any financial transactions within the hotel.

36. Limited Access Areas

Access to certain areas within Azura Resorts may be restricted to hotel guests only. Nikoa Beach Club members should respect and adhere to these restrictions.

37. Compliance with Azura Resorts Policies

Nikoa Beach Club members are expected to comply with all Azura Resorts’ policies and regulations while utilizing their facilities.

38. Guest Access to Azura Resorts Restaurants

Members may bring guests to dine at Azura Resorts’ restaurants, subject to the guest policy mentioned in the Nikoa Beach Club agreement.

Charges for services not covered by the guest will be billed to the sponsoring member’s club

39. Changes to Access Privileges

Azura Resorts reserves the right to modify or restrict Nikoa Beach Club members’ access to its facilities, including restaurants, based on hotel policies and operational 

Admission Rights

40. Admission Rights

Nikoa Beach Club reserves the right to deny admission or revoke access to its facilities, including Azura Resorts’ restaurants, at its sole discretion.

Grounds for denial or revocation of access may include but are not limited to:

Violation of Nikoa Beach Club policies, rules, or regulations.

Disruptive behavior or actions that may disturb the peace and enjoyment of other members, guests, or hotel patrons.

Failure to comply with Azura Resorts’ policies and regulations.

Non-compliance with the terms and conditions outlined in the Nikoa Beach Club agreement.

Outstanding membership fees or charges.

Any other actions or behaviors deemed inappropriate or inconsistent with the standards set by Nikoa Beach Club.

Members will be notified in writing of any denial or revocation of access, and the reasons for such action will be communicated.

In the event of denial or revocation, Nikoa Beach Club may, at its discretion, outline steps for reinstatement of access privileges, subject to compliance with specified conditions.

Discounted Services

41. Aquatic Sports

Nikoa Beach Club members enjoy a 10% discount on Aquatic Sports services offered within the property.

Members are required to present their membership app or other identification to avail of the discount.

All charges for Aquatic Sports activities are the responsibility of the member and must be settled directly according to the facility’s payment policies.

42. Monkey Tours Daily Tours

Nikoa Beach Club members receive a 10% discount on Monkey Tours Daily Tours.

To claim the discount, members must present their membership app or other identification at the time of booking.

Members are responsible for settling any charges related to Monkey Tours directly with the tour operator, following their payment policies

43. Britt Shop Access with Discount

Nikoa Beach Club members have the privilege of accessing the Britt Shop, the souvenir store located in the Azura area, with an exclusive membership discount.

Presentation of the membership app or other identification may be required for entry into the Britt Shop.

Members are entitled to a 10% discount on purchases made at the Britt Shop.

Any purchases made at the Britt Shop are the responsibility of the member and must be settled directly with the shop according to its payment policies.

44. Morpho’s Spa Services

Nikoa Beach Club members are entitled to a 10% discount on spa services, including massages, at Morpho’s Spa.

To avail of the discount, members must present their membership app or other identification at the time of booking spa services.

Members are responsible for settling any charges related to spa services directly with Morpho’s Spa, adhering to their payment policies.

The 10% discount applies only to the member’s spa services and is non-transferable.
